The Supreme Court of the United States has affirmed a federal court decision that has invalidated a patent covering a drug that was later sold to a patient. The decision is one of the most significant examples of the Court’s ever-changing role in the pharmaceutical industry.
The decision is particularly notable because it was the first of a series of decisions, beginning with a ruling in May 2014, that the FDA approved Viagra, the generic drug approved by the FDA for erectile dysfunction, for its use as an anti-impotence drug.
According to the drug maker Pfizer, the FDA approved Viagra for treatment of erectile dysfunction by May 2014, and it was the first drug approved to treat a condition that is classified as a sexually transmitted disease. In 2016, the drug maker submitted a formal application for approval for the use of Viagra to treat a patient with pulmonary arterial hypertension.
The decision was based on the Supreme Court’s ruling in the case of Pfizer’s patent for Viagra, which provides protection for impotence.
